REDACTION - Why?

 Justice is blind (or should be). 

Anonymity ensures impartiality.  Accordingly, ArbItRite asks its customers to redact every document submitted for the Panel's consideration. How do you redact a document?  First, remove. Second Replace.  Remove all references to  names and  information that identify a  Claimant or Respondent from all documents or exhibits to be submitted.   This can be done manually, e.g., by obliterating names and logos with a permanent marker, then scanning the marked document into an image file - to be uploaded as part of your submission.  Replace where clarity requires a indentification of a party;  Letters or numbers can be used instead of names. Thus "Mr. Smith" is replaced by  "Mr. S." Several software packages exist that perform automatic redaction. (See below.)  Statements and Replies  -- which are prepared by a party --  are to be written without referring to your name or the name of your adversary, using the replacement technique discussed above.  An example appears below.

Potential Conflicts of Interest

The retired judges who serve as
ArbItRite's  Neutrals, and the lawyers who assist them, are all experienced attorneys who have decided cases, represented clients, facilitated transactions, or resolved disputes involving Fortune 500 companies, as well as countless individuals, business entities and organizations of every description. As such, any attorney or jurist retained by ArbItRite for your case may at one time have decided a case in which you or your adversary were a party, or may even have represented you, or your adversary in some capacity.   The attorneys or judges retained by ArbItRite are ordinarily affiliated with law firms, businesses, or organizations that may have current clients or interests adverse to your interests or goals.  All ArbItRite  Neutrals, and the attorneys who assist them, take a solemn oath,  to render justice fully and fairly under the law regardless of the identity or any characteristic or attribute of the parties who submit their disputes to ArbItRite.  In addition to that undertaking, ArbItRite  has adopted procedures such as redaction to ensure that the identity of the parties appearing before our Neutrals is not know to them.   ArbItRite's confidential staff reviews all submissions to ensure that redaction is complete. As such justice can be rendered impartially, based upon the merits alone.

​If you are unable to redact your documents your ArbItRite Coordinator will redact your documents for an additional fee .  

ArbItRite's general policy of  anonymity, and its specific requirement for redacted documents is designed to eliminate the
possibility that one of our Neutrals will have a conflict of interest, or potential conflict of interest, e.g., because he or she may have represented one of the parties in the past. Anonymity ensures that since the judge who renders your decision will not know the identity of any party s/he cannot be biased by any facet of your identity be it, race, creed, origin, prior affiliation, or any other factor,  In the unlikely event that the  identity of any party is  inadvertently disclosed to, or otherwise discerned by one of our
Neutrals, they have each agreed to recuse themselves immediately, and will be replaced by another equally qualified jurist at no cost to the parties or delay in proceedings.  Accordingly, parties to ArbItRite proceedings waive any potential conflict of interest as part of the Submission Agreement.

 Claimant Able Corp. is a jeweler that sustained a theft of its  salesman's sample case containing $75,000 worth of blue white diamonds. Able presented a claim to Baker Insurance Co, on a Proof of Loss form signed by its president, Kermit DeFrog,  under its Jewelers Block policy (attached) which Baker declined for late notice, and the excluded infidelity of Abel's employee, Joseph Crunq.
